NRI Power of Attorney by by Deal4Property Legal Consultant

A Power of Attorney(POA) is not an instrument of transfer in regard to any right, title or interest in an immovable property. The power of attorney is creation of an agency whereby the grantor authorizes the grantee to do the acts specified therein, on behalf of grantor, which when executed will be binding on the grantor as if done by him/her. The person authorizing the other to act on his/her behalf is the ​Principal/Grantor. The one authorized to act is the Attorney/Agent/Grantee. The Attorney cannot use the power of attorney for his/her own benefit. He/she acts in a fiduciary capacity.

The NRI person who due to professional preoccupations is unable to come to Kolkata to dispose of/buy any property or has any other obligation in Kolkata to fulfill in hassle-free manner maintaining legality and has a reliable person to whom he/she is willing to give Power for such purposes, then in lieu of professional charges the entire procedural help will be given  by  the Deal4property through its Legal Consultant (conducting the same from her High Court Office).

After drafting the Power of Attorney the Deal4property Legal Consultant  will sent it through EMAIL to the concerned Non resident Indian.Taking the print out of  that Power of Attorney in A4 papers, the NRI should get in presence of atleast two witnesses his/her signature and photographs attested by concerned Indian Embassy/Consulate and has to sent through postal service the signed and attested Power of Attorney to the Kolkata based address of the Attorney Holder and  within three months thereof,the said Power of Attorney along with the envelop and other documents (Power of Attorney holder’s photographs,ID proofs etc) requires to be authenticated by the appropriate Authority(not the registering authority in case of Kolkata) through the help of the High Court legal wings of the Deal4property Legal Consultant and after such authentication said Power of Attorney will be considered as legally admissible under Indian context and can be used to represent that NRI before any Judicial.Quasi-Judicial, Statutory (Municipal,B.L.& L.R.O. etc),Revenue,Registering as well as Local Authorities in India for the purposes specified in the said Power of Attorney and the acts,deeds,matters and things done by the Attorney thereof by virtue of that Power shall be considered to be done by that NRI person.
